THE ARTIST

1.1 Only artists aged over 18 years may apply. If a third party wishes to submit work on behalf of an artist, they must do so with the artist’s written consent.

ARTWORK

2.1. Work submitted may be on any medium except photography and providing it is suitable for posting.

2.2.The Work must be available from the end of October 2023 and following, unless agreed between artist and Helena Boase.

2.3. Work must have been made in the last three years.

2.4. The Work must be for sale.

2.5. If framed, work must include the size of paper unframed and framed.

2.6. Work must be under 100x100(x100)cm.

APPLICATION PROCESS

3.1. All Work must be submitted via email by the Deadline.

3.2. Send high-resolution images of works along with size (framed and unframed if painting or prints), medium, price, and date completed, to thebottegacollective@gmail.com.

3.3. Artists will be informed on selection outcome within two weeks of competition deadline.

3.4. Selected works will be part of the online exhibition for the Autumn/Winter, with potential to move into regular online shop with agreement of the artist.

3.5. Artwork that is not available for sale during these dates should not be submitted. 

PHOTOGRAPHING ARTWORK

4.1. Please photograph works in natural light and on a light background. Please make sure the edges of the work are included in the photo.

4.2. Artwork must be photographed unframed and (if relevant) framed.

4.3. Photos submitted will be used for online exhibition.

4.4. Low-quality images may lead to work being excluded from online exhibition.

4.5. Images that do not show the authentic artwork will be disqualified.

DELIVERY OF WORKS 

5.1. Artists must be able to post artworks in a professional and efficient manner within two weeks of purchase (if not possible – to be discussed with Helena). 

PRICING AND COMMISSION

6.1. Works must be for sale.

6.2. Sale prices must include consideration of any framing cost (if relevant) and commission (35%).

6.3 The Bottega Collective will charge a 35% commission on the total sale price.

6.4 Works submitted must be for sale exclusively with the Bottega Collective.

6.5 Artwork prices must include the commission of 35% plus VAT. If the artist is registered for VAT, then the VAT due on the selling price of the Works should be included in the price entered on the form.

6.6 It is the Artist’s responsibility to declare any sale of work as income for tax purposes.

INTELLECTUAL PROPERTY RIGHTS

7.1 By submitting your Work(s), You confirm that the Work(s) is free and clear of any liens, claims, encumbrances or restrictions, that the use of the Work(s) under these Terms will not infringe upon or violate the rights of any person or entity, and that to the best of Your knowledge and belief the Work(s) has not been exported from any country and shall not be imported into the United Kingdom in violation of any applicable laws or regulations.

7.2 If you do not own all of the rights, title and interest in and to the Work(s), You must expressly inform Bottega Collective in writing of all relevant details concerning all other third parties rights to the Work(s). You shall indemnify Bottega Collective against all losses, liabilities, costs and expenses in respect of claims made by third parties alleging partial or total ownership of the Work(s) or any rights in the Work(s), including intellectual property rights.

7.3 Bottega Collective have the right to copy and/or reproduce the Works and to communicate and/or issue such copies to the public in connection with the exhibition, for advertising the sale of the Works, and for general marketing or promotional purposes, and other related activities, including without limitation the incorporation of images of the Works within promotional and marketing materials, postcards, catalogues, posters, DVDs, on Bottega Collective’s websites, and any media now known or hereafter devised. Permission will be sought from the artist before reproduction. Any sales generated from the reproduction of the artist’s work will be subject to a 35% commission, unless otherwise specified.

PERSONAL DATA

8.1 Bottega Collective will hold the personal data supplied by the artist on the submission form, in accordance with the General Data Protection Regulation (GDPR). It will only be used for administering exhibitions, commissions and prizes and will not be transferred to a third party without the consent of the artist, subject to clause 8.2 below.

8.2 Unless expressly written to the contrary, the artist hereby consents to Bottega Collective providing third parties with his or her contact details where such third parties might be interested in buying, commissioning or licensing the rights in and to, the Works.

REFUSAL, WITHDRAWAL OR DISQUALIFICATION OF WORK

9.1 Bottega Collective may accept or decline any Work(s) submitted for the online exhibition entirely at its own discretion.

9.2 Bottega Collective reserves the right to deny admission or withdraw a Work(s) from the Exhibition if for any reason the Work(s), or any circumstances surrounding the display of the Work(s), appears to Bottega Collective to expose it to potential or actual damage to its reputation, risk of legal proceedings or enforcement including, without limitation, the alleged breach of third party intellectual property rights.

14.3 Bottega Collective reserves the right to disqualify any Work if the artist has failed to adhere to these Terms and Conditions.

THE SIGNING OF BOTTEGA COLLECTIVE’S SUBMISSION FORM IS TO BE TAKEN AS THE UNRESERVED AGREEMENT OF THE ENTIRE CONTENTS OF THESE TERMS AND CONDITIONS AND THOSE ON THE SUBMISSION FORM BY THE SIGNATORY.

BY SUBMITTING TO THE EXHIBITION YOU ARE DEEMED TO ACCEPT AND AGREE TO THE FOLLOWING:

The decision of the Selectors on all matters is final and no correspondence will be entered into.

I understand that The Organisers reserves the right to make such changes to the exhibition arrangements and these Terms & Conditions as may be deemed necessary by circumstances.

I authorise The Organisers to process, store, and utilise the data in my submission and agree that, if selected for exhibition, images of my work can be freely used by The Organisers, The Collective and associated organisations for promotional and publicity purposes.

All information provided by me is true and accurate and the work submitted is wholly of my own creation.

I have read and understood these terms and conditions and by submitting this application I accept and agree to observe all the Terms And Conditions therein.
